This website is operated by Modular Homes 400 Inc., an Ontario corporation with its registered office at 142 Oakdale Road, Unit 3, Toronto, ON M3N 1V9 (“Modular Homes 400,” “we,” “us”). These Terms of Use, together with our Privacy Policy, govern your access to and use of modularhomes400.com and any subdomains (the “Site”).
2. What This Site Is
The Site is an information and lead-generation platform for modular housing in Ontario. It includes:
- Information about modular homes, manufacturers, and the Parkland Series specifically.
- Tools for assessing eligibility, including the ADU/ARU Checker.
- Resources for buyers, REALTOR®s, landowners, government, and service partners.
- Forms for inquiries, quote requests, and downloads.
- An AI chatbot that answers questions about modular housing.
The Site is operated alongside transaction services provided by James Clarke, REALTOR® (TRREB), who is a licensed Ontario REALTOR® and not the same legal entity as Modular Homes 400 Inc.
3. The ADU/ARU Eligibility Checker — Informational Only
The ADU/ARU eligibility checker is an informational tool. It returns a directional answer based on Ontario provincial regulation (Ontario Regulation 299/19) and our database of municipal zoning rules. The binding answer to whether you can build an Additional Residential Unit on your property comes from your municipal building department, not from this tool.
Use the result as a starting point for further investigation. Do not rely on it as the final determination of eligibility. We update the underlying data regularly but cannot guarantee currency in every municipality at every moment.
4. Pricing, Specifications, and Availability
All pricing on this Site is indicative. Final pricing is established in a written purchase agreement between the buyer and the manufacturer. Prices may change without notice. Currency is Canadian dollars (CAD) unless explicitly stated otherwise.
Manufacturer specifications, model availability, floor plans, and delivery timelines are subject to change by the manufacturer. We make reasonable efforts to keep the Site accurate but cannot guarantee that every detail is current at every moment. Confirm specifications with us in writing before signing any purchase agreement.
5. Not Legal, Financial, or Tax Advice
Content on the Site — including the REALTOR® Guide, Buyer's Checklist, blog posts, FAQ answers, and chatbot responses — is for general information. It is not legal, financial, accounting, tax, mortgage, or zoning advice. Don't rely on it for decisions that have legal or financial consequences. Engage qualified professionals (lawyer, accountant, mortgage broker, planner) for advice specific to your situation.
This applies in particular to the HST New Housing Rebate, mortgage qualification, CSA Z240MH financing pathways, ARU zoning compliance, and any tax-related content.

- Share links to public pages on the Site.
- Use the gated REALTOR® Guide and Buyer's Checklist for the purposes for which they were provided to you, including sharing the Buyer's Checklist with your own clients in your professional capacity.
You may not:
- Reproduce, republish, or commercially distribute Site content without our written permission.
- Strip our branding, attribution, or notices from any content.
- Scrape the Site or use automated tools to extract data without our written permission. (Search engine crawlers respecting robots.txt are exempt.)
- Use our trademarks, including “Modular Homes 400” and the green house logo, in any way that suggests endorsement or affiliation we have not granted.
7. Submissions to the Site
When you submit information through forms, the chatbot, or other means, you confirm that the information is accurate, that you have the right to provide it, and that you are not violating anyone else's rights or any applicable law. We use your submissions as described in our Privacy Policy.
8. Third-Party Links and Services
The Site contains links to third-party websites and uses third-party services (manufacturer sites, partner sites, government resources, Google Places, Chatbase, etc.). We don't control those sites or services and aren't responsible for their content, practices, or privacy policies. Use them at your own discretion and read their terms.
9. Disclaimers
The Site is provided “as is” and “as available.” To the maximum extent permitted by Ontario law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 10. Limitation of Liability
To the maximum extent permitted by Ontario law, Modular Homes 400 Inc., its directors, officers, employees, contractors, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these terms or the Site is limited to one hundred Canadian dollars (CAD $100).
Nothing in these terms limits liability that cannot be limited under Ontario law, including liability for fraud, willful misconduct, or personal injury caused by negligence.
11. Indemnification
You agree to indemnify and hold harmless Modular Homes 400 Inc. and its directors, officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these terms or your misuse of the Site.
12. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising from these terms or the Site will be resolved in the courts of Ontario sitting in the City of Toronto, and you consent to the exclusive jurisdiction of those courts.
13. Termination
We can suspend or terminate your access to the Site at any time, with or without notice, if you violate these terms or for any other reason. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
14. Changes to These Terms
We may update these terms from time to time. The “Last updated” date at the top reflects the most recent version. Continued use of the Site after changes take effect constitutes acceptance of the new terms. Material changes will be flagged on the home page for at least 30 days before taking effect.
