Modular Homes & Garden Suites in Port Colborne, Ontario

Factory-direct modular homes and backyard suites for the City of Port Colborne — the city itself, Humberstone, Gasline, Lorraine, Bethel, the hamlet of Sherkston and the Lake Erie shoreline. On October 14, 2025 Port Colborne replaced its backyard-suite rules city-wide: a detached unit is now as-of-right in any zone where a house is permitted, including the hamlet, rural and agricultural zones, it can be 7 m tall, and its size is set as a share of your house rather than a fixed number. The by-law posted on the City's website has not caught up — so read this before you order anything.

What you can build in Port Colborne

1 · Who's it for?

2 · What layout?

3 · What size feels right? (Port Colborne lots typically allow up to 45% of your home)

Port Colborne caps all the additional units on a lot together at 45% of the main house's gross floor area — on a 1,600 sq ft house that is 720 sq ft, shared with any basement apartment you already have. The detached unit itself can be up to 7 m tall. On well and septic the lot must be at least 0.4 ha (0.99 acres). Check your address for the practical number. Can you put a garden suite (ADU) in your Port Colborne backyard?

Often, yes — Port Colborne permits a detached Additional Residential Unit on most serviced residential lots. The specifics, from City of Port Colborne Comprehensive Zoning By-law 6575/30/18 §2.9 (Additional Dwelling Units), as amended by By-law 7393/84/25, passed October 14, 2025:

Max sizeAll additional units on the lot together at most 45% of the main house's gross floor area — a 1,600 sq ft (149 m²) house allows 720 sq ft (67 m²) in total. No fixed m² ceiling
Max height7 m (≈23 ft) for a detached unit — a metre more than the 6 m (≈20 ft) ordinary accessory buildings get
Setbacks1 m (≈3 ft) interior side & rear · 1.5 m (≈5 ft) from the main house · 4.5 m (≈15 ft) to the street-side lot line on a corner lot · not in a required front yard or a sight triangle
Where allowedAny zone where a single-detached, semi-detached, duplex or townhouse dwelling is permitted — the urban R zones plus Hamlet Residential, Rural Residential, Lakeshore Residential, Agricultural Residential, Agricultural and Rural. In the Agricultural and Rural zones only on an existing lot of record, and never inside a building used for farming
Units per lotOne detached unit. Total units: 4 on urban residential land, 3 in the hamlet and rural areas, 2 in the agricultural area — the extra units go inside the house
Lot coverageThe greater of your zone's figure or 45% for buildings with additional units — but the older 5% (unserviced) and 1% (Agricultural/Rural) accessory caps were not amended, so confirm with the City on a rural lot
ParkingOne space per additional unit, and tandem parking counts (up to two vehicles nose-to-tail)
ServicingMunicipal or private. On well and/or septic the lot must be at least 0.4 ha (0.99 acres) and the septic must carry the extra flow — the septic permit comes from Niagara Region, not the City
ConservationNiagara Peninsula Conservation Authority (NPCA) — a permit before anything is built in the Hazard zone along Lake Erie; an Environmental Impact Study first in the Environmental Protection zone or Conservation layer; 10 m from any municipal drain

Getting your building permit in Port Colborne

An eligible lot still needs a building permit before anything is delivered. Here's how Port Colborne's process actually works — verified against the Port Colborne building department's own pages.

How do you apply for an ADU building permit in Port Colborne?

Through the City Hall counter — there is no online portal. The City of Port Colborne Building Division takes a completed application at 66 Charlotte Street; forms are downloadable PDFs and the Division's email is buildingadmin@portcolborne.ca (905-835-2900). This is neither Cloudpermit nor CityView. The septic permit is a separate application to Niagara Region, and that one is online through the Region's portal. The City's page says to submit the completed application at City Hall; an incomplete application is placed on hold until everything is in. Ask the Building Division whether it will accept the package by email before you drive it over. Port Colborne's building-permit page ↗

  1. Confirm your zone and which area you are in — urban, hamlet, rural or agricultural — because that sets how many units the lot can hold. Zoning questions go to Planning at 905-835-2900 or planning@portcolborne.ca. If you are on well and septic, confirm the lot is at least 0.4 ha; below that the by-law does not permit the unit.
  2. If you are on private services, start the septic work first — it is the long pole. Niagara Region issues the sewage system permit (not the City), online through its own portal, and the Official Plan requires the unit to connect to the existing system if it has the capacity or a new system to be built if it does not.
  3. Get any conservation clearance. In the Hazard zone along Lake Erie nothing can be built until the Niagara Peninsula Conservation Authority issues a permit; in the Environmental Protection zone or Conservation layer an approved Environmental Impact Study comes first.
  4. Prepare the drawings and the provincial Application for a Permit to Construct or Demolish with Schedule 1 (Designer Information), an Energy Efficiency Design Summary if new HVAC is designed, and Schedule 2 if a new septic system is part of the project.
  5. Bring the complete application and drawings to City Hall and pay the non-refundable application fee, which is credited against the final permit fee.
  6. Building Code and zoning review. Anything missing or non-compliant comes back as a deficiency, and the statutory clock pauses until you resolve it.
  7. Pay the balance of the permit fee and the deposit, then collect the permit.
  8. Book the inspections listed on the permit as construction proceeds.

What does an ADU permit application in Port Colborne need?

  • Application for a Permit to Construct or Demolish (the provincial form) with Schedule 1 — Designer Information
  • Site plan, legible and to scale, showing lot lines, the existing house, the proposed detached unit, its setbacks and the calculated lot coverage (the City publishes a sample site plan)
  • Construction drawings — floor plans, elevations, cross-sections and structural details, fully dimensioned, identifying materials and the use of each room. For a CSA A277 factory-built unit the manufacturer's certified drawing set covers the factory-built portion
  • Energy Efficiency Design Summary (EEDS) where new HVAC is designed, and the Commitment to General Review form where an architect or engineer designs the unit
  • Proof of servicing: for a serviced lot, the municipal water and sanitary connections; for a rural lot, the Niagara Region sewage system permit (Schedule 2 for a new system) and evidence the well and septic can carry the extra load
  • NPCA permit or clearance where the property falls in the Hazard zone or a regulated area
  • Agent of Authorization form where someone other than the owner is applying

How much does an ADU building permit cost in Port Colborne?

From the City's 2026 Rates and Fees, Schedule O, read directly. A new dwelling unit is charged at the Group C residential rate of $1.85 per square foot, with a minimum permit fee of $165 — so an 800 sq ft detached unit works out to roughly $1,480. The $165 application fee paid at submission is credited against that. Plumbing is $13 per fixture plus $1.80 per linear foot of buried piping, and a house HVAC permit is $185. The City also holds a refundable deposit — $605 for an accessory building to a house — and may require a $2,410 lot-grading deposit. On a rural lot the septic permit is the bigger separate number and it is paid to NIAGARA REGION, not the City: $1,200 for a new sewage system, $625 to replace a tank, $415 to decommission one. All amounts are estimates; confirm current rates with the Building Division at 905-835-2900 before you budget.

Septic (Niagara Region, not the City)$1,200 for a new sewage system; $625 to replace a tank; $415 to decommission — applied for separately through the Region's online portal
Development chargesExempt — the City's staff report on the ADU amendment states that additional dwelling units are exempt from development charges and parkland conveyance; see the note below

The City's own Recommendation Report 2025-198 on the October 2025 ADU amendment states that additional dwelling units are exempt from the payment of development charges and from the conveyance of parkland under a combination of provincial and local legislation, and the City's fees page lists one or two new units in an existing dwelling among its exemptions. The Development Charges Act exempts one unit in a detached ancillary building on any parcel. For scale, a new single-detached unit otherwise attracts $13,785 in City charges on a rural lot or $31,732 with full urban services (October 23, 2025 to October 22, 2026 schedule), plus Niagara Region's charge. Get the exemption confirmed in writing for your specific proposal — the City's DC contact is gary.long@portcolborne.ca, 905-228-8062.

How long does an ADU building permit take in Port Colborne?

Ontario's Building Code requires a decision on a complete house-class application within 10 business days. A house-class permit carries the Ontario Building Code's 10-business-day review period, and the clock only starts on a complete application — the City places an incomplete one on hold. The real schedule risk on a hamlet or rural lot sits before the clock starts: the Niagara Region sewage system permit is a separate application to a separate authority, and an NPCA clearance in the Hazard zone is its own timeline again. Start both early.

Registration: No separate additional-dwelling-unit registration or licensing fee appears in the City's 2026 fee schedule — the building permit is the approval. Council considered an owner-occupancy requirement and staff recommended against it; a registration by-law could come later as a separate initiative (Report 2025-198). Port Colborne licenses short-term rentals separately, so renting the unit nightly rather than monthly is a different regime.

Worth knowing before you apply

  • The septic permit is a different authority. Niagara Region administers Part 8 of the Ontario Building Code for Port Colborne — the exceptions in Niagara are Wainfleet, West Lincoln and Welland, which run their own. So a hamlet or rural build means two applications to two organizations: the City for the building permit and Niagara Region (905-980-6000) for the sewage system.
  • There is no online building-permit portal. The City's page directs you to submit the completed application at City Hall, and an incomplete application is put on hold rather than reviewed — so use the City's checklist and keep your own record of what you handed in and when.
  • The rule that catches people is not a size cap in square feet — it is the 45% share. All the additional units on the lot together may total at most 45% of the main house's gross floor area, so an existing basement apartment eats into the backyard unit's budget. Size the house first, then the unit.
  • The City's own building guides warn that they are being updated and may contain outdated information, and its Secondary Unit guide (August 2024) predates the October 2025 amendment. Use them for the permit checklist, not for the zoning numbers.
  • An NPCA permit is a prerequisite, not a formality, anywhere in the Hazard zone — and along Lake Erie that zone covers the flooding, erosion and dynamic-beach hazards. A municipal drain on or beside the lot adds a 10 m setback from its top of bank.

Fees and timelines are estimates from Port Colborne's published schedules, verified October 11, 2026. Rates and processes change — always confirm current requirements with the building department before you apply.

Port Colborne modular homes — FAQ

Can you build a detached backyard suite in Port Colborne?

Yes. Since By-law 7393/84/25 was passed on October 14, 2025, Section 2.9 of the zoning by-law permits one detached additional dwelling unit as-of-right on any lot where a single-detached, semi-detached, duplex or townhouse dwelling is permitted — in any zone, not just the urban residential ones. That brings in the Hamlet Residential, Rural Residential, Lakeshore Residential, Agricultural Residential, Agricultural and Rural zones. In the Agricultural and Rural zones the house itself is only a permitted use on an existing lot of record, and the unit can never be inside a building used for farming.

How big can a backyard unit be in Port Colborne?

There is no fixed square-metre cap. All of the additional units on the lot together — a basement apartment plus a backyard unit, say — may total at most 45% of the gross floor area of the main house, measured from the inside face of the exterior walls. On a 1,600 sq ft house that is 720 sq ft in total; if you already have a unit inside the house, the backyard unit gets whatever is left of that budget. The detached unit may be up to 7 m tall, 1 m from a side or rear lot line and 1.5 m from the house.

Does the Port Colborne zoning by-law on the City website show the current rules?

No. The consolidation posted on portcolborne.ca is the 2021 update, and its Section 2.9.1 still shows the old rules — one unit per lot, 40% of the house, a 6 m height limit, and detached units only in a residential zone. By-law 7393/84/25 replaced all of that on October 14, 2025, in force on passing with no appeal available except by the Minister. We read the amendment itself on the October 14, 2025 Council agenda; ask Planning (905-228-8130, planning@portcolborne.ca) for the current text.

Who issues the septic permit for a rural Port Colborne property?

Niagara Region, not the City. The Region administers Part 8 of the Ontario Building Code — the on-site sewage system rules — for every Niagara municipality except Wainfleet, West Lincoln and Welland. So a hamlet or rural build means two desks: the City of Port Colborne Building Division for the building permit and Niagara Region (905-980-6000) for the sewage system permit. The zoning by-law also requires a lot that is not on municipal sewer and water to be at least 0.4 ha, and the Official Plan requires the unit to connect to the existing septic system if it has the capacity, or a new system to be built if it does not.

Can you put a modular home in Port Colborne?

Yes, on a permanent foundation. The by-law defines a mobile home as a residence designed and manufactured to be transported on its own chassis, and permits one only as temporary accommodation under a Development Agreement. A CSA A277 modular unit set on a permanent foundation is an ordinary building and qualifies as a house or as the detached additional unit. A unit left on its own chassis is a mobile home under this by-law and is not a route to a backyard suite. Sherkston Shores is a separate case: the resort is zoned Vacation Residential, which permits no dwelling at all.

How much does a modular home or backyard suite cost in Port Colborne?

Modular home models start at $175,696 and run to about $338,000 for the largest layouts; backyard ADU models start at $96,244. Site work, foundation, delivery, and permits are additional.

Can I get a mortgage on a modular home in Port Colborne?

Yes — on a permanent foundation it is financed as real property, including via CMHC Prefab Plus (5% down on the first $500,000).

Local rules summarized from City of Port Colborne Comprehensive Zoning By-law 6575/30/18 §2.9 (Additional Dwelling Units), as amended by By-law 7393/84/25, passed October 14, 2025; verified by Modular Homes 400 and reviewed by James Clarke, REALTOR®.
