West Lincoln caps a detached suite at the LESSER of 100 m² (≈1,076 sq ft) or 40% of your home's floor area — an attached garage or basement associated with the suite counts toward the suite's area. 40% of a typical 150 m² (≈1,615 sq ft) house is 60 m² (≈646 sq ft). Can you put a garden suite (ADU) in your West Lincoln backyard?

Often, yes — West Lincoln permits a detached Additional Residential Unit on most serviced residential lots. The specifics, from Township of West Lincoln Zoning By-law 2017-70, §3.2.1 — Accessory Dwelling Units (July 25, 2025 consolidation):

Max sizeThe LESSER of 100 m² (≈1,076 sq ft) or 40% of your home's gross floor area — and a garage or basement associated with the suite counts toward the suite's area, not on top of it. So a 150 m² (≈1,615 sq ft) house caps the suite at 60 m² (≈646 sq ft); reaching the full 100 m² takes a house of 250 m² (≈2,690 sq ft) or more. On a Smithville town lot there's a second geometry gate: most residential zones cap an accessory building's ground floor at 50 m² (≈538 sq ft) and total accessory coverage at the lesser of 100 m² or 8% of the lot — so a full-size suite usually means a second storey (the RuR and R1A zones allow a 120 m² / ≈1,292 sq ft ground floor).
Where it goesUp to two ADUs per home — but at least one must be inside or attached to the house, so the detached backyard suite is the second unit (§3.2.1 a). It can't go in the front or exterior side yard, must sit within 50 m (≈164 ft) of the house, and is permitted in the Agricultural (A) zone and the residential zones (RuR, R1A–R1D, R2, R3, RM1–RM4, RH) — but not the Agricultural Purposes Only (APO) zone, and near a livestock operation the Minimum Distance Separation formulae apply.
Height & setbacksIn the residential zones: 1.2 m (≈4 ft) side and rear setbacks, 1.5 m (≈5 ft) from the house, and a 5 m (≈16 ft) height cap for a single-storey accessory building. In the Agricultural zone: 2 m (≈6.5 ft) setbacks, 3 m (≈10 ft) from the house, 5.5 m (≈18 ft) height. The 8 m (≈26 ft) allowance applies only when the suite sits above the first storey — e.g. over a garage (§3.1, §3.2.1 f).
Parking1 space for the suite, accessed from the same driveway as the house — no separate driveway (§3.2.1 k, Table 6).
ServicingMunicipal services in Smithville. On a well-and-septic lot (Caistor Centre, St. Anns, Wellandport, the rural concessions) the lot must be at least 0.4 ha (≈1 acre) and the private water and sewage services must be approved with adequate capacity for the extra unit — a separate septic system for the suite is allowed only in extenuating circumstances, so plan on connecting to the existing system (§3.2.1 l). West Lincoln issues its own septic permits — one of only three Niagara municipalities that administer their own sewage-system approvals, so building permit and septic are one desk.
ConservationNiagara Peninsula Conservation Authority (NPCA) — the Twenty Mile Creek and Welland River watersheds. In an NPCA-regulated floodplain or wetland, an NPCA permit is required on top of the Township building permit.

Getting your building permit in West Lincoln

An eligible lot still needs a building permit before anything is delivered. Here's how West Lincoln's process actually works — verified against the West Lincoln building department's own pages.

How do you apply for an ADU building permit in West Lincoln?

Through the Township of West Lincoln Building Division (email or in person — no online permit portal), 318 Canborough Street, Smithville, 905-957-3346 ext. 5130 (application portal ↗). West Lincoln has no online permit portal: email the completed application package to buildingpermit@westlincoln.ca (attachments over 20 MB may not be received), or bring it to the Township Office at 318 Canborough Street, Smithville (9 a.m.–4:30 p.m. weekdays; secure drop box at the rear of the building). Payment is debit, cash or cheque at the office, or EFT on request. Confirm the current process and fees with the Building Division (905-957-3346 ext. 5130). West Lincoln's building-permit page ↗

  1. Confirm zoning — up to two accessory dwelling units per home are as-of-right under Zoning By-law 2017-70 §3.2.1, with the detached backyard suite as the second unit (at least one unit must be inside or attached to the house). The suite is capped at the lesser of 100 m² or 40% of your home's floor area, must sit within 50 m of the house, and isn't permitted in the APO zone. A Zoning Compliance review from the Township is $350 (2026).
  2. Check the Niagara Peninsula Conservation Authority (NPCA) — in a regulated floodplain or wetland (Twenty Mile Creek and Welland River watersheds), NPCA clearance is required before the building permit.
  3. On a rural well-and-septic lot (Caistor Centre, St. Anns, Wellandport, the concessions): the lot must be at least 0.4 ha, and your private water and sewage services must be approved with adequate capacity for the extra unit — a separate septic for the suite is allowed only in extenuating circumstances. West Lincoln administers its own sewage-system approvals, so the septic application goes to the same Building Division (a new or replacement Class IV system is $1,740 under the 2026 fee schedule).
  4. Retain a qualified BCIN designer for the Ontario Building Code construction drawings (an owner designing their own project may claim the homeowner exemption on Schedule 1).
  5. Assemble the package — building permit application, site plan or survey, structural drawings, septic evaluation/permit where applicable, engineered truss drawings where applicable, NPCA clearance where applicable, and the Radon Gas Mitigation Selection Form (required for all new construction).
  6. Submit by email or in person with the fees and deposits; respond to any plans-examination comments.
  7. Book inspections through construction to occupancy — building and septic inspections via the Township Building Division, plus the separate ESA electrical inspection. Deposits are refunded when the permit file closes.

What does a West Lincoln ADU permit application need?

  • Building permit application (the Township's Building General or New Dwelling form) + Schedule 1 Designer Information (BCIN, or the homeowner exemption)
  • Site plan / survey plan showing property lines, setbacks from all lot lines and structures, and the proposed construction (see the Township's Survey Requirements document)
  • Structural drawings to scale — floor plans, elevations and cross-sections (engineered truss drawings where applicable)
  • Radon Gas Mitigation Selection Form — required for all new construction
  • Septic / On-site Sewage System permit application (rural well+septic lot) — issued by the Township's own Building Division
  • Niagara Peninsula Conservation Authority (NPCA) clearance, where the lot is in a regulated area

How much does an ADU building permit cost in West Lincoln?

Building-permit fees follow the Township's Consolidated Schedule of Fees and Charges (effective January 1, 2026): residential dwellings are $18.13 per m², so a ~600 sq ft (56 m²) detached suite works out to roughly $1,000–$1,100 — confirm with the Building Division how a detached ADU is classified (the accessory-building rate is $5.00/m²; the minimum permit fee is $196). A new Class IV septic system adds $1,740, and refundable security and lot-grading deposits apply. All figures are estimates — confirm with the Building Division (905-957-3346 ext. 5130).

Building permit — residential dwelling rate$18.13 per m² of floor area (2026 schedule) — ≈ $1,088 on a 60 m² (646 sq ft) suite; the garage/carport/shed accessory-building rate is $5.00 per m², so confirm how a detached ADU is classified
Minimum permit fee$196 (2026 schedule)
Septic (sewage-system) permit — rural lot$1,740 for a new or replacement Class IV system / $720 for a tank replacement or minor repair, issued by the Township's own Building Division (2026)
Refundable security deposit$800 for an accessory building over $3,500 construction value — $2,500 if the suite is deposited as a dwelling — refunded when the permit file closes (2026); a lot-grading deposit ($1,939 per dwelling outside a new subdivision) may also apply
Zoning Compliance review$350 (2026 planning fee schedule)
Development chargesEXEMPT for a qualifying ADU — DC By-law 2024-70 §3.5 writes the provincial exemption in (a new single-detached home otherwise pays $31,380–$37,456 in Township DCs at January 1, 2026 rates)

West Lincoln's DC By-law 2024-70 (§3.5, Exemptions for Intensification of Existing or New Housing) exempts a qualifying additional dwelling unit from development charges — against Township charges of $31,380 (rural) to $37,456 (urban serviced) per new single-detached home at January 1, 2026 rates, plus Niagara Region's own charges. The detached-suite (ancillary building) exemption is written for urban residential land — confirm the treatment for a rural lot with the Building Division.

How long does an ADU building permit take in West Lincoln?

Ontario's Building Code requires a decision on a complete house-class application within 10 business days. The Township says the permit process takes approximately three weeks, with some projects longer depending on requirements. An NPCA clearance (regulated floodplain or wetland) comes first and can add time, as can the septic-capacity confirmation on a rural lot.

Registration: West Lincoln does not publish a separate ADU registration or licensing fee — the building permit is the approval. Confirm with the Building Division.

Worth knowing before you apply

  • There is no online permit portal — applications go by email (buildingpermit@westlincoln.ca, 20 MB attachment limit) or in person at 318 Canborough Street, Smithville. Payments are debit, cash or cheque at the office (EFT on request); online payment isn't available.
  • Naming trap: what the by-law calls a 'garden suite' is a TEMPORARY portable unit needing a Temporary Use By-law — a $4,215 planning application (2026) plus an owner agreement. The permanent backyard suite is the 'accessory dwelling unit' and needs only the building permit — don't apply for the wrong instrument.
  • West Lincoln is one of only three Niagara municipalities that administer their own sewage-system approvals (with Wainfleet and Welland) — septic and building permit are the same Township desk, not a regional office.
  • Budget for the refundable deposits: a security deposit ($800 accessory / $2,500 dwelling-class, 2026) and possibly a lot-grading deposit ($1,939) are held until the permit file closes — real money in float even though it comes back.
  • The Radon Gas Mitigation Selection Form is required for all new construction — an easy miss that makes the application incomplete.
  • The big number is a saving: a qualifying ADU is exempt from development charges (DC By-law 2024-70 §3.5) that would otherwise run $31,380–$37,456 for a new home at 2026 Township rates.

Fees and timelines are estimates from West Lincoln's published schedules, verified August 27, 2026. Rates and processes change — always confirm current requirements with the building department before you apply.

Grants & financing in West Lincoln

Development charges — exempt for a qualifying ADUA new single-detached home in West Lincoln pays $31,380 in Township development charges on a rural lot and $37,456 on an urban serviced lot (January 1, 2026 rates, DC By-law 2024-70) — before Niagara Region's own charges. The Township's by-law writes the provincial ADU exemption in (§3.5): a qualifying additional dwelling unit pays none of it. The detached-suite exemption is written for urban residential land, so confirm the treatment for a rural lot with the Building Division before budgeting.

West Lincoln modular homes — FAQ

Can you build a garden suite / ADU in West Lincoln?

Yes — Zoning By-law 2017-70 (§3.2.1) permits up to two accessory dwelling units per home as-of-right in the Agricultural zone and the residential zones, and one may be a detached backyard suite (at least one of the two must be inside or attached to the house). One naming caution: what West Lincoln's by-law calls a 'garden suite' is a temporary portable unit needing a Temporary Use By-law (a $4,215 planning application) and an owner agreement — the permanent backyard suite is the 'accessory dwelling unit', and it needs only a building permit.

How big can a backyard suite be in West Lincoln?

The lesser of 100 m² (≈1,076 sq ft) or 40% of your home's gross floor area — and an attached garage or basement associated with the suite counts toward the suite's area. So a 150 m² (≈1,615 sq ft) house caps the suite at 60 m² (≈646 sq ft), and the full 100 m² takes a house of about 250 m² (≈2,690 sq ft) or more. On a Smithville town lot, most residential zones also cap an accessory building's ground floor at 50 m² (≈538 sq ft) and total accessory coverage at the lesser of 100 m² or 8% of the lot — so a full-size suite usually means building over a garage or a second storey.

Can you build an ADU on well and septic in West Lincoln?

Yes — on a rural lot the by-law permits the suite where the lot is at least 0.4 ha (≈1 acre) and the private water and sewage services are approved with adequate capacity for the extra unit (§3.2.1 l). A separate septic system for the suite is only allowed in extenuating circumstances, so plan on connecting to the existing system — and get the capacity confirmed before you design. Conveniently, West Lincoln administers its own sewage-system approvals (one of only three Niagara municipalities that do), so the septic permit and the building permit come from the same Township desk.

Can you put a modular home in West Lincoln, Ontario?

Yes. On land you own, a CSA A277 modular home on a permanent foundation is legal residential housing under the Ontario Building Code throughout the Township of West Lincoln — in Smithville and across the rural wards — as the principal dwelling or as the detached accessory dwelling unit in your backyard under §3.2.1.

How much does a modular home or backyard suite cost in West Lincoln?

Modular home models start at $175,696 and run to about $338,000 for the largest layouts; backyard ADU models start at $96,244. Site work, foundation, delivery, and permits are additional.

Can I get a mortgage on a modular home in West Lincoln?

Yes — on a permanent foundation it is financed as real property, including via CMHC Prefab Plus (5% down on the first $500,000).
